Kate Smith explores case law on Personal Independence Payment (PIP) Activity 2 — Taking Nutrition to see who can meet the point scoring descriptors.
To qualify for the daily living component of PIP a claimant needs to score at least 8 points from 10 activities. Following the announcement in the government’s Green Paper, Pathways to work: Reforming Benefits and Support to Get Britain Working, from November 2026 the component will only be paid if 4 points are scored in at least one activity and the total number of points is at least 8.
Scoring points for taking nutrition can be tricky because of the way the activity is written and interpreted. It is worth looking in detail at the wording of the activity and the case law that’s been decided about what it means so that arguments can be made to score points.
