Social Security Scotland appealed the First Tier Tribunal’s decision, and their appeal was upheld.
The claimant was awarded SRDL only of ADP but SSS appealed on the “required period condition’ i.e. 13 weeks prior to the claim being made and 39 weeks post claim.
The case will be remitted back to a differently constituted FTS tribunal to consider the relevant start and end dates of the required period.
